Der Wert eines Schutzes des Privaten wird regelmäßig auf die geschützten Individuen bezogen. Danach ist sie grundlegend für Autonomie und Intimität. Dass daneben und darüber hinaus das Private auch gesellschaftliche Relevanz erlangen kann, ist schon weniger im Fokus wissenschaftlicher Aufmerksamkeit. Noch weniger gilt dies für ihre demokratische Dimension. Privatleben, pluralistische Gesellschaft und Demokratie stellen in Verfassungen und politischer Diskussion zentrale Themen dar. Prima facie erscheinen sie dort negativ zugeordnet. Das Private ist dann der Grenzfall der Demo- kratie - und umgekehrt. Diese Sicht soll hier befragt und differenziert werden.
Reference is regularly made to the individuals being protected when the value to be placed on protecting the private sphere is discussed. According to this, it forms the basic principles for autonomy and intimacy. The fact that, in addition and beyond this, the private domain may also be of societal relevance has been much less the focus of aca- demic studies. This applies even less to its democratic dimension. Private life, pluralist society and democracy form central topics in constitutions and political discussion. On a prima facie basis, they appear to have negative connotations in these regards. The private domain then forms the borderline case of democracy - and vice versa. The aim in this paper is to subject this to questioning and differentiation.
