Vor 75 Jahren trat das Grundgesetz für die Bundesrepublik Deutschland in Kraft. Wie hat sich diese Verfassung bewährt? Welche Rolle spielt das Bundesverfassungsgericht für die Wirkung der Verfassung? Hier soll untersucht werden, in welcher Weise die wichtigsten Normen der Verfassung zur Staatsorganisation und andererseits die Grundrechtsgewährleistungen zur Geltung gebracht und weiterentwickelt worden sind. Das Grundgesetz hat in der Ausprägung durch das Bundesverfassungsgericht über die Jahrzehnte hin zu einer freiheitlichen Ordnung und zu wirtschaftlichem Wohlstand des Landes beigetragen. Gleichwohl wird seine Entwicklung nicht nur von Gegnern des repräsentativen Systems kritisiert, sondern auch von Beobachtern, denen an der Bewahrung der grundlegenden Entscheidungen gelegen ist. Gefragt wird insbesondere, was Verfassungsanwender und Richter tun können, um angesichts großer Krisen und einer gespaltenen Gesellschaft die Zukunftsfähigkeit der Verfassung zu erhalten. Entscheidend wird letztlich sein, wie sich das politische Bewusstsein der Bürgerinnen und Bürger entwickelt.
The Basic Law for the Federal Republic of Germany came into force 75 years ago. How has this constitution stood the test of time? What role does the Federal Constitutional Court play in the effect of the constitution? The aim here is to examine the way in which the most important norms of the Constitution on the organization of the state and, on the other hand, the guarantees of fundamental rights have been enforced and further developed. Over the decades, the Basic Law, as shaped by the Federal Constitutional Court, has contributed to a liberal order and to the economic prosperity of the country. Nevertheless, its development is not only criticized by opponents of the representative system, but also by observers who are interested in preserving the fundamental decisions. In particular, the question is what constitutional practitioners and judges can do to maintain the future viability of the constitution in the face of major crises and a divided society. Ultimately, the decisive factor will be how citizens' political awareness develops.
La Loi fondamentale de la République fédérale d'Allemagne est entrée en vigueur il y a 75 ans. Comment cette constitution a-t-elle résisté à l'épreuve du temps ? Quel rôle joue la Cour constitutionnelle fédérale dans l'application de la Constitution ? Il s'agit ici d'examiner la manière dont les normes les plus importantes de la Constitution relatives à l'organisation de l'État et, d'autre part, les garanties des droits fondamentaux ont été appliquées et développées. Au fil des années, la Loi fondamentale, telle qu'elle a été définie par la Cour constitutionnelle fédérale, a contribué à l'instauration d'un ordre libéral et à la prospérité économique du pays. Néanmoins, son évolution est critiquée non seulement par les opposants au système représentatif, mais aussi par les observateurs soucieux de préserver les décisions fondamentales. En particulier, la question est de savoir ce que les praticiens et les juges constitutionnels peuvent faire pour maintenir la viabilité future de la Constitution face à des crises majeures et à une société divisée. En fin de compte, le facteur décisif sera l'évolution de la conscience politique des citoyens.
